The court already proved that Kim Hyun Joong is not guilty of the charges slapped against him by his ex-girlfriend. However, his day in court is not yet over as his former flame, who was known as Ms. Choi, made an appeal about the damage compensation.
On Jan. 11, the former lovers are back in court to continue their legal battle. According to Allkpop, the two was not able to reach an agreement during the appeal hearing filed by Ms. Choi.
Regarding the new case, the woman's lawyer said that they are filing an appeal because the original agreed damage compensation for Ms. Choi which amounts to KRW1.6 billion (US$1.34 million) was reduced to KRW700 million only or US$588,000.
The lawyer added that this compensation is for Ms. Choi's mental stress brought about by having to think if she will start her relationship over with the singer or not. He further said that the singer's parents rejection of Choi's offer was another cause of his client's stress so they are asking for the right compensation.
On the other hand, Hyun Joong's side explained that since Choi accepted settlement money worth KRW600 million or US$504,000 during the early part of the legal battle, she violated the settlement ruling so she cannot ask for more. The singer's legal team also said that Ms. Choi tormented their client by announcing a fake pregnancy and lying with other related issues.
The "Breakdown" singer's legal rep stated, "Kim Hyun Joong believed her when she said she was pregnant and claimed to have a miscarriage after she was assaulted." The lawyer said that when Hyun Joong entered the army, he was incredibly maligned and defamed. His situation was so severe that he is not sure whether he can still make a comeback as a celebrity.
For the record, in connection with what she did to Hyun Joong, Ms. Choi has been charged with defamation and attempted fraud. She was ordered to pay a hefty penalty and it was reported that she will be appealing this court order as well, ASZ News reported.
Meanwhile, the singer is set to be released from the army this coming Feb. 11. His discharge is expected to be sensationalized because of his on-going legal battle with his ex.
