Former NBA MVP Derrick Rose is set to miss the New York Knicks' training camp this summer after the judge that is handling his sexual assault case denied his camp's motion to dismiss the said lawsuit.
Rose, who left his old club Chicago Bulls to sign with the Knicks this summer, and two of his friends were charged of gang-raping a woman called "Jane Doe" in August of 2013. The 29-year-old accuser is said to have had a previous "sexual relationship" with the NBA player, according to an earlier report from the Chicago Tribune.
The three-time NBA All-Star had denied the accusations both publicly and in-court proceedings and have recently passed a motion to terminate the case as one of the accuser's former roommates and co-workers, Keyana LaVergne, went out and said that Rose is innocent and Doe is just attempting to "extort money from Derrick Rose based on sham allegations".
La Vergne was subpoenaed after Doe's attorney objected that a series of text messages between Rose and the accuser be made public. It was reported that the messages contain the accuser's admission of financial problems and that she "could not let this lawsuit go because of this".
Fansided reported that Judge Michael W. Fitzgerald of the United States District Court in the Central District of California declared "There can be no doubt that genuine disputes exist as to almost every material fact in this action."
It means that it was not clear whether the sex act between the two parties are consensual or not so the case will have to go on trial.
The scheduled date of the proceedings will be on Oct. 4 and a "lengthy trial could impact Rose and his new team based on the fact he might have to commute back and forth from California to participate in the Knicks' practices and games", the report noted.
Rose, who had previously played all of his seven seasons in Chicago, is entering his first year suited up for another ballclub other than the Bulls. He was traded to the Knicks together with Justin Holiday and a 2017 second-round pick in exchange for José Calderón, Jerian Grant, and Robin Lopez on June 22.
